On Wednesday Governor Brian Kemp signed the COVID-19 Safe Harbor bill, SB 359, into law.
The law will protect businesses, health-care facilities and sports venues across the state from COVID-19 lawsuits. Lawsuits can still be brought, but the impacted person must demonstrate that the transmission of COVID-19 was the result of gross negligence, willful and wanton misconduct, reckless infliction of harm, or intentional infliction of harm.
The Metro Atlanta Chamber pushed for the bill’s passage and was a major priority of our RESTORE initiative.
The law went into effect upon the Governor’s signature and remains in effect until July 14, 2021, which means the issue could be revisited in the 2021 legislative session.
